The Plans' Trustees have developed these Guidelines based on their experience over
many years in applying the requirements of the Screen Actors Guild collective
bargaining agreements that contributions be based on that part of the compensation
that is for covered acting services.
Over these years, the Plans have had many discussions with producers regarding the
application of the collective bargaining agreement requirements in various
circumstances. We have published these Guidelines at the suggestion of producers
that knowledge of the Plans' approach would assist in their compliance with the
requirements of the collective bargaining agreements. We are hopeful that you
will find these Guidelines helpful in that regard.
Finally, you will note that these Guidelines are not strict rules, but are, indeed,
"guidelines." While we believe that the Guidelines will normally be applicable,
we invite you to bring to our attention any factual circumstances that you believe
would suggest contributions should be on some other basis. Thus, for example, the
Plans may take into account the impact of the Guidelines on producers who entered
into contracts prior to the publication of these Guidelines. As we have always
done, the Plans will carefully consider any such factual circumstances and discuss
with you any appropriate adjustment.
